Réemploi après congé parental

Comme j'ai pu trouver dans un article du site : "le congé parental est une suspension du contrat de travail avec garantie de reprise dans l'emploi à l'issue du congé". (référence réglementaire??...) Hors je suis en CDI dans la fonction publique hospitalière et le decret n°91-155 du 6 février 1991 stipule (art.30) que les agents physiquement aptes sont réemployés sur leur emploi ou occupation précédente dans la mesure permise par le service. Dans le cas contraire, ils sont licensiés et disposent d'une priorité de réemploi dans l'établissement pour exercer des fonctions similaires.
Donc, qu'en est-il réellement? Le décret me semble suffisamment clair, je n'ai aucune garantie de réemploi après un congé parental, mais cela me semble contre toute la logique du code du travail...

Le congé parental est un droit que l'employeur ne peut refuser. Toutefois lors du retour de l'employé, il n'est pas tenu de lui conserver le même emploi.
Un licenciement est également possible mais dans des conditions assez restrictives et pour des raisons d'ordre économique. La fonction hospitalière bénéficie, en outre, d'un statut bien particulier. Il faudrait peut-être s'adresser à un syndicat.

Quand on me dit 3 ans de congé parental je cris. Dernièrement des amis m'ont dit que le dernier mois n'était pas complet. Mon fils est né le 27 aout , il parrait que je doit reprendre le 1er Aout. Je pensais reprendre au 1er septembre. Résultat soucis dans le mode de garde pendant un mois.......
S'il était né le premier septembre j'aurais repris en même temps que lui, c'est injuste.....
