Voici mon témoignage. Dîplomée d'état dans le secteur social depuis 10 ans, j'ai postulé sur un emploi au sein de l'association dans laquelle je travaille déjà, sur un autre service. Il s'agit d'une appel d'offre interne pour deux postes vacants. Après avoir passé deux entretiens, ma candidature n'a pas été retenu. Lors du deuxième entretien, la directrice m'a laissé entendre qu'elle souhaitait donner priorité à un homme sur au moins un des deux postes. Lorsqu'elle m'a contactée pour m'annoncé que ma candidature n'avait pas été retenue, elle s'est justifiée en disant que ce n'était pas lié à une question de compétences, me faisant savoir qu'elle avait beaucoup apprécié notre entrevue, et que je ne m'étais pas "plantée", mais qu'elle avait favorisé une candidature masculine sur un des postes, et la candidature de quelqu'un (une femme) avec qui elle travaille déjà au sein de l'association. J'apprends quelques jours plus tard, de sources sûres, que l'homme qui a été recruté ne fait pas parti de l'association et se trouve être un jeune professionnel tout juste sorti de l'école. J'apprends, de surcrôit, et toujours de sources sûres que ce dernier s'est finalement désisté et que le poste est à nouveau vacant. La directrice ne m'a pas recontactée... elle chercherait toujours un homme, négligeant ainsi ma candidature. Que puis-je faire? Ayant cette information, j'hésite à la relancer afin qu'elle revienne sur sa décision. J'ai plusieurs questions quant à ce procédé de recrutement, à savoir, à priori, à compétences égales, elle favorise un homme, en as-t-elle le droit? à compétences inégales (10 ans d'expérience me concernant, aucune concernant l'autre candidat), en as t-elle le droit? Et enfin, si les employeurs doivent donner priorité à une diffusion interne des offres, est-ce que cette règles s'applique pour le recrutement, auquel cas, je pourrais être victime d'une double discrimination... L'employeur doit-il faire la démonstration ou pas nécessairement de l'impossibilité à recruter en interne? si oui, selon quels critères?
