CDD + congé maternité

Si  l'article L1225-4 du Code du travail interdit le licenciement pendant le congé de maternité il ne l'empêche pas de démissionner car il ne fait que protéger le salarié et ne bénéficie pas à l‘employeur.

Depuis la loi de modernisation sociale du 17 janvier 2002, le salarié peut légitimement rompre un contrat à durée déterminée avant l'échéance du terme prévu lorsqu'il "est justifié d'une embauche pour une durée indéterminée" (article L. 1243-2 du Code du travail).

le salarié est alors tenu de respecter une période préavis dont la durée est :

-d'un jour par semaine compte tenu de la durée totale du contrat, renouvellement inclus, en cas de contrat à terme précis ;

-Ou d'un jour par semaine compte tenu de la durée effectuée en cas de contrat sans terme précis ;

Et, dans les deux cas, dans une limite maximale de deux semaines.

Mais d' après l'article L 1225-34 du code du travail un salarié en état de grossesse médicalement constaté peut démissionner et sans préavis et sans indemnité de rupture.

Méfiez vous cependant de cette démission qui vous fera perdre tout droit aux ASSEDIC voir toute  indemnité au titre du congé de maternité il serait préférable pour vous de négocier un licenciement avec votre employeur, sachant que toute absence prolongée ne laisse à l'employeur que la possibilité de vous licencier pour faute..

je suis, je pense dans le même cas. Mon congé maternité se termine le 19 mai et mon employeur, qui semblait d'accord lors de notre entrtien pour rompre ce contrat à l'amiable, me dit aujourd'hui que ce n'est pas possible et qu'il faut que je revienne 4 semaines après mon congé pour pouvoir faire quoi que ce soit.

Je précise que cet employeur est relativement peu conciliant et que pendant toute ma grossesse, elle m'a affecté aux postes les plus difficiles de la structure (je suis animatrice et j'ai du gérer toutes les activités sportives des enfants les plus âgés, par exemple) car elle n'était pas contente que je sois enceinte.

Je suis en cdd pour remplacement d'une salariée en formation et si je dois y retourner cela mettra en péril la formation professionnelle que j'ai entrepris depuis 1 an.
